Terms of Use

Please read these Terms of Use (“Terms”) carefully before accessing or using Finclar (“the Application,” “we,” “us,” or “our”). By creating an account, downloading, or otherwise using Finclar, you agree to be bound by these Terms in their entirety. If you do not agree with any provision of these Terms, you must not use the Application.

1.1 About Finclar

Finclar is a personal expense tracking application that enables users to record, categorise, and review their spending. The Application offers the following core functionalities:

Manual entry of individual expense transactions.

Receipt scanning using optical character recognition (OCR) to automatically extract transaction data from uploaded images of receipts.

Read-only integration with third-party bank accounts and financial institutions to import transaction data automatically.

AI-powered analysis and insights to help users understand their spending patterns.

Finclar is not a financial institution, payment service provider, e-money institution, or digital wallet. The Application does not hold, move, store, or transmit money on your behalf at any time. No funds are deposited into or disbursed from Finclar.

2.1 Age Requirement

You must be at least 18 years of age, or the age of majority in your country of residence (whichever is higher), to create an account and use Finclar. By registering, you represent and warrant that you meet this requirement. We reserve the right to terminate any account we reasonably believe to be held by a minor.

2.2 Accurate Information

You agree to provide accurate, current, and complete information during registration and to keep that information up to date. Providing false, misleading, or fraudulent information is a material breach of these Terms and may result in immediate account termination

2.3 Account Security

You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately at support@finclar.app if you suspect any unauthorised access to or use of your account. We will not be liable for any loss or damage arising from your failure to safeguard your credentials.

2.4 One Account per User

Each user may hold only one active account. Creating duplicate accounts or accounts on behalf of another person without their express authorisation is prohibited.

3.1 Permitted Use

Subject to these Terms, Finclar grants you a personal, non-exclusive, non-transferable, revocable licence to access and use the Application solely for your own lawful personal finance management purposes.

3.2 Prohibited Conduct

You agree not to:

Use the Application for any commercial purpose or on behalf of any third party without our prior written consent.

Attempt to gain unauthorised access to any part of the Application, its servers, or any connected systems.

Reverse engineer, decompile, disassemble, or attempt to derive the source code of the Application.

Use the AI features to generate advice intended to circumvent applicable financial regulations.

Use the Application in any manner that violates applicable local, national, or international law or regulation.

4.1 Read-Only Access

Where you elect to connect a bank account, Finclar accesses your account data strictly on a read-only basis. This means that Finclar can retrieve transaction history and account balance information solely for display and analysis within the Application. Finclar cannot and will not initiate payments, transfers, or any other transactions on your behalf.

4.2 Third-Party Service Providers

Bank connectivity is facilitated through regulated open-banking or financial data aggregation providers. By connecting your bank account, you also agree to the terms and conditions of those third-party providers, which will be presented to you at the point of connection. We are not responsible for any acts or omissions of those providers.

4.3 Your Responsibility

You are responsible for ensuring that connecting your bank account to Finclar does not violate the terms of your agreement with your bank or any applicable law. You may disconnect your bank account at any time from within the Application settings.

4.4 Data Accuracy

Transaction data imported via bank integration is presented as received from your financial institution. Finclar does not guarantee the accuracy, completeness, or timeliness of such data. You should independently verify important figures against your official bank statements.

5.1 Nature of Insights

Finclar uses artificial intelligence and machine learning to analyse your expense data and present insights, spending summaries, trend analyses, budget projections, and categorisation suggestions. These outputs are generated for informational and illustrative purposes only.

5.2 Not Financial Advice

Nothing produced by Finclar’s AI features, nor any content within the Application, constitutes financial advice, investment advice, tax advice, legal advice, or any other form of regulated professional advice. Finclar is not authorised or licensed to provide financial advice in any jurisdiction.

6.1 Finclar IP

All intellectual property rights in the Application, including but not limited to software, algorithms, design, graphics, trademarks, and content created by Finclar, are owned by or licensed to Finclar. Nothing in these Terms transfers any ownership of such rights to you.

7.1 No Liability for Financial Decisions

To the fullest extent permitted by applicable law, Finclar shall not be liable for any loss or damage, whether direct, indirect, incidental, consequential, or otherwise, arising from your reliance on any financial insight, categorisation, or projection generated by the Application.

8.1. Modifications to These Terms

We reserve the right to update or modify these Terms at any time. Where changes are material, we will notify you in the app.

Your continued use of the Application after the effective date of revised Terms constitutes your acceptance of those changes

9.1 Termination by You

You may close your account at any time from within the Application settings or by contacting us at support@finclar.app. Upon closure, you may request deletion of your personal data in accordance with our Privacy Policy.

9.2 Termination by Us

We reserve the right to suspend or permanently terminate your account, with or without notice, if we reasonably determine that you have:

Violated these Terms or any applicable law.

Engaged in fraudulent, abusive, or harmful conduct.

Provided false registration information.

Attempted to compromise the security or integrity of the Application
